Third Party Funding Observatory
Welcome to the Third Party Funding Observatory, an independent initiative whose mission is to serve as an online clearinghouse for news, information, commentary, and resources on third party funding.
As part of its mission, the Third Party Funding Observatory is pleased to assist the ICCA-Queen Mary Task Force on Third Party Funding in International Arbitration to disseminate its draft report on third party funding. The draft report will be available for public comment from 1 September to 31 October 2017. It is available for download on this website, and can also be found on ICCA’s website (www.arbitration-icca.org).
The Third Party Funding Observatory is also providing a tailored platform for any and all interested parties to provide comments to the Draft Report (please click on the Comments Tab above to do so). The Comments section of the Third Party Funding Observatory website makes it easy to send, read, and reply to comments, and the resulting information gathered will provide important feedback that will be incorporated into the final report.
According to the Task Force, in the lead up to the launch of the final report at the ICCA Congress in Sydney in April 2018, the Task Force will also be discussing the draft report with representatives of the insurance industry, maritime arbitration practitioners and other international arbitration experts. The Task Force Co-Chairs, Professor Catherine Rogers, Professor Stavros Brekoulakis and ICCA Governing Board member Professor W.W. (Rusty) Park, look forward to engaging with public comment on the draft, which will include chapters on the impact of third party funding on costs and security for costs, attorney-client privilege, and conflicts, together with overarching chapters on definitions and best practices.
The Comments section of the Third Party Funding Observatory website makes it easy to post, read, and respond to comments. All comments posted will be forwarded to the Co-Chairs, and private comments can also be sent in directly to tpftaskforce@arbitration-icca.org. Your feedback is important for efforts to revise the Report in anticipation of its formal launch at ICCA Congress in Sydney in April 2018.
